LIMITATION OF LIABILITYWE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, THE SERVICES, OR THE SOFTWARE USED TO OPERATE THEM. THIS INCLUDES, BUT IS NOT LIMITED TO: LOSS OF BUSINESS OPPORTUNITIES; LOST PROFITS; FAILURE TO REALIZE EXPECTED RESULTS; DELAYS IN DELIVERY OR PROCESSING TIMES; CLAIMS BY THIRD PARTIES; AND ANY OTHER DIRECT OR INDIRECT DAMAGES.
GOVERNING LAWThese Terms shall be governed by and construed in accordance with the laws of Nevada, USA, without regard to conflict-of-laws principles. Any disputes arising out of these Terms must be resolved through arbitration using a single arbitrator chosen mutually by us and you.
MODIFICATIONS AND TERMINATIONWe may change or modify any aspect of the Services at our sole discretion. We reserve the right to terminate your access to the Services if we believe, in our reasonable judgment, that such action is necessary due to an unauthorized use of the Software, a failure to comply with these Terms, or other reasons not prohibited by Nevada Gaming Regulations.
JURISDICTIONAL ISSUESYou agree to be subject to the jurisdiction and laws of the State of Nevada for any disputes arising out of your use of the Services. We reserve all rights to bring any action in any court within our sole discretion to enforce these Terms.
COUNTRY-SPECIFIC TERMS AND CONDITIONSBy accessing or using the Services, you acknowledge that we are a USA-based gaming company subject to Nevada Gaming Regulations and applicable laws governing online and land-based gaming activities in each country where the Services may be accessed by you.
ENTIRE AGREEMENTThese Terms represent the entire agreement between us with respect to your access to and use of the Services. Any oral or written representations, agreements or understandings not expressly set forth within these Terms are deemed void and unenforceable.
